4. Purchases, Rentals, and Payments

4.1 Pricing and Availability

All prices, item availability, fees, and promotions are subject to change at any time without notice. We reserve the right to:

  • Correct pricing errors
  • Cancel orders affected by pricing errors (with a full refund if charged)
  • Limit quantities available for purchase or rental
  • Refuse or cancel orders at our discretion
4.2 Payment Authorization

When you place an order or rental, you authorize us (and our payment processors, including PayPal) to charge your payment method for:

  • Item purchase price(s)
  • Rental fees
  • Security deposits (for rentals)
  • Shipping and handling charges
  • Applicable taxes
  • Late fees (for overdue rentals)
  • Damage or loss fees (for rental items)
  • Restocking fees (if applicable)
  • Any other fees disclosed at checkout
4.3 Taxes

You are responsible for all applicable taxes associated with your purchases and rentals, unless we are legally required to collect and remit such taxes on your behalf.

4.4 Chargebacks

If you initiate a chargeback or payment dispute without first contacting us to resolve the issue, we may:

  • Suspend your account
  • Restrict future purchases and rentals
  • Report the dispute to credit agencies or collection services
  • Pursue legal remedies for amounts owed

5. Rental Terms (Important)

Please Read Carefully: This section contains important terms regarding rental periods, returns, late fees, and your liability for damage or loss of rental items.

This section applies to any product offered for rent ("Rental Item").

5.1 Rental Period

The rental period begins on the date you take possession of the Rental Item (as confirmed by delivery confirmation, tracking delivery scan, or pickup timestamp) and ends on the due date/time shown at checkout and in your order confirmation (the "Rental Period").

5.2 Return Requirements and Condition

You must return all Rental Items:

  • On or before the due date specified in your rental agreement
  • In the same condition as received (normal wear and tear excluded)
  • With all included parts, accessories, manuals, cases, packaging, and documentation
  • Using the return shipping method specified in your rental confirmation

We may inspect items upon return. If inspection requires time, additional charges (if applicable) may be assessed after inspection is complete.

5.3 Late Fees

If a Rental Item is returned late, you agree to pay late fees as disclosed at checkout and/or shown in your account. Late fees:

  • May accrue daily until the item is returned
  • Will be charged to the payment method on file
  • Are non-refundable once incurred

If a Rental Item is not returned within 14 days after the due date, it may be deemed lost, and you will be charged the full replacement value plus any accumulated late fees.

5.4 Loss, Theft, or Irreparable Damage

If a Rental Item is lost, stolen, not returned, or returned with damage beyond normal wear, you agree that we may charge you:

  • Repair costs (including parts, labor, and shipping)
  • Replacement value (full retail value of the item)
  • Shipping and handling costs
  • Administrative fees
  • Any other reasonable costs associated with recovery or replacement

You agree to cooperate with any investigation regarding lost or stolen items, including providing police reports if requested.

5.5 Your Responsibility for Safe Use

You are solely responsible for:

  • Using Rental Items safely and as intended
  • Following all manufacturer instructions and guidelines
  • Ensuring proper handling, installation, and operation
  • Supervising any minors who may interact with Rental Items

You assume all risk of injury or property damage arising from the use, misuse, improper installation, unsafe operation, or failure to follow instructions regarding any Rental Item.

5.6 Rental Extensions

Rental extensions:

  • Are not guaranteed and subject to availability
  • Must be requested and approved before the original due date
  • May require additional rental fees
  • Will result in a new due date upon approval

To request an extension, contact us at support@rentarailroad.com before your rental is due.

5.7 Security Deposits

Some Rental Items may require a security deposit. Security deposits:

  • Are authorized at checkout and may be held on your payment method
  • Will be released within 7-10 business days after the item is returned in acceptable condition
  • May be applied to late fees, damage charges, or replacement costs if applicable

6. Shipping, Delivery, and Pickup

Delivery dates and times provided are estimates only and are not guaranteed. We are not responsible for delays caused by:

  • Shipping carriers
  • Weather conditions
  • Customs delays (for international orders)
  • Incorrect addresses provided by you
  • Acts of God or other circumstances beyond our control

Risk of loss for purchased items passes to you upon delivery. For rental items, risk of loss remains with you from the time you receive the item until we confirm receipt of the returned item.

If you provide an incorrect address, refuse delivery, or fail to retrieve a shipment, you may be responsible for:

  • Additional shipping charges
  • Re-delivery fees
  • Storage fees
  • Any late fees that accrue for rental items

7. Refunds, Returns, and Cancellations

Refund eligibility depends on the type of transaction, item condition, and timing.

7.1 Purchased Items
  • Unopened items in original packaging may be returned within 30 days for a full refund
  • Opened items may be subject to a restocking fee
  • Items must be returned in the same condition as received
  • Return shipping costs are the responsibility of the buyer unless the item was defective or incorrectly shipped
7.2 Rental Items
  • Rental fees are generally non-refundable once the rental period begins
  • Early returns do not result in partial refunds unless otherwise specified
  • Cancellations made before the item ships may receive a full refund
7.3 Defective Items

If you receive a defective item, please contact us within 48 hours of delivery. We will arrange for a replacement or refund at our discretion.

7.4 Processing Time

Refunds are typically processed within 5-10 business days after we receive and inspect the returned item. Refunds will be issued to the original payment method.

8. User Content: Reviews, Forum Posts, and Messages

The Service may allow you to post content, including reviews, ratings, comments, forum posts, profile images, and other materials ("User Content").

8.1 You Own Your Content — But You Grant Us a License

You retain ownership of your User Content, but by posting it, you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to:

  • Host, store, and backup your User Content
  • Reproduce, modify, and adapt it (for formatting and display)
  • Display and distribute it on the Service
  • Use it to operate, improve, and promote the Service

  • That rental items will be suitable for your intended use

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by applicable law.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION.
  • OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE OR ANY ITEM WILL NOT EXCEED THE GREATER OF:
    • (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR
    • (B) $100 USD.

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

  • Your User Content

  • Your violation of any applicable law or third-party rights
  • Your misuse, damage to, or loss of any Rental Item
  • Any claim by a third party related to your activities on the Service

17. Dispute Resolution

READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
17.1 Informal Resolution First

Before filing any claim or lawsuit, you agree to contact us at legal@rentarailroad.com with:

  • Your name and account email
  • Order or rental details (if applicable)
  • A description of the dispute
  • The relief you are seeking

We will attempt to resolve the dispute informally within 30 days of receiving your notice.

17.2 Binding Arbitration

If we cannot resolve the dispute informally, you and we agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (including the formation, interpretation, breach, or termination of these Terms) will be resolved by binding, individual arbitration, except as provided below.

Arbitration will be administered by the American Arbitration Association ("AAA") under its applicable Consumer Arbitration Rules. Information about the AAA and its rules is available at www.adr.org.

17.3 Exceptions to Arbitration

Either party may:

  • Bring individual claims in small claims court (if eligible)
  • Seek injunctive or other equitable relief for intellectual property infringement or unauthorized access to the Service
17.4 Class Action Waiver

You and we agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.

You may opt out of this arbitration agreement by sending written notice to legal@rentarailroad.com within 30 days of:

  • First accepting these Terms, OR
  • Your first transaction on the Service

(whichever is earlier)

Your notice must clearly state that you wish to opt out of arbitration and include your name, address, email address, and account username.

17.6 Governing Arbitration Law

The Federal Arbitration Act ("FAA") governs this arbitration agreement and preempts any inconsistent state law.

18. Governing Law and Venue

Except where preempted by federal law (including the FAA), these Terms and any disputes arising hereunder are governed by the laws of the State of California, without regard to conflict of law principles.

If a dispute is permitted to proceed in court (e.g., if arbitration is found unenforceable), you agree to submit to the exclusive personal jurisdiction of the state and federal courts located in Los Angeles County, California.

19. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or other factors.

When we make changes:
